If you reason that it’s the best approach practically, you do that. If you’re a consequentialist, and you don’t believe in rights in a perfect sense, you still have a rights-based system as one of your possibilities in that guessing game. You can’t win, so you try to pick the best option you can and do the work required to limit that suffering. But if you play a rights-based approach, you also run the risk of doing something that also has the potential to ruin lives. This of course requires that you actually do your due-diligence because as you said, your guessing with people’s lives. You should do the thing that you believe will lead the the least suffering given that you have sufficient reason to believe that it will. But you’re leaving so much suffering on the table if you don’t try. I do agree that rights-based ethical systems are much easier. Yes, it is a guessing game, but it’s not just willy-nilly.
